By accessing or using the KORTYX platform and any related services provided by ThirdPowerAI (a division of Third Power Enterprises LLC), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the platform. Use of the platform constitutes your acceptance of all terms herein.

KORTYX is intended for business use by authorized representatives of organizations. You must be at least 18 years of age and have the legal authority to enter into agreements on behalf of your business. You agree not to use the platform for any unlawful purpose, to transmit harmful content, or to attempt to gain unauthorized access to any system or network.

All content, software, models, workflows, and designs comprising the KORTYX platform are the exclusive intellectual property of ThirdPowerAI and Third Power Enterprises LLC. No license to reproduce, distribute, or create derivative works is granted, expressed, or implied. Client data processed through the platform remains the property of the client.

We are committed to responsible data stewardship. Data submitted through KORTYX is used solely to provide and improve the contracted services. We do not sell client data to third parties. All data handling practices are governed by our Privacy Policy and applicable federal and state law. Voice recordings and AI interactions may be stored for quality assurance purposes with appropriate safeguards in place.

ThirdPowerAI will make commercially reasonable efforts to maintain platform availability. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice. We are not liable for losses resulting from scheduled maintenance, unexpected downtime, or third-party service interruptions outside of our direct control.

To the maximum extent permitted by applicable law, ThirdPowerAI and Third Power Enterprises LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or business interruption, arising from your use of the KORTYX platform. Our total aggregate liability shall not exceed the fees paid by you in the three months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or use of the platform shall first be submitted to good-faith mediation. Unresolved disputes shall be subject to binding arbitration in accordance with JAMS rules. Both parties waive the right to a jury trial.

ThirdPowerAI reserves the right to update these Terms of Service at any time. Material changes will be communicated via email or prominent notice on the platform at least 14 days before taking effect. Continued use of the platform following the effective date of any changes constitutes your acceptance of the revised terms. The most current version will always be available at thirdpowerai.com.
